DAS Terms & Conditions

THE OWNER/AGENT AND DISCOUNT AUTO SHIPPERS AGREE TO THE FOLLOWING:

1. Owner or Owner's agent warrants that he/she is the registered legal owner of the vehicle(s), or that he/she has been duly authorized by the legal owner to enter into this Agreement.

2. The vehicle(s) will be transported by Discount Auto Shippers or any carrier Discount Auto Shippers brokers to, who shall be referred to herein as “Carrier.” Owner agrees to allow Discount Auto Shippers to act as its agent in dealing with the Carrier and to exercise its efforts on Owner's behalf in placing the order with the Carrier they deem fit. Said Carrier will route vehicle(s) from origin to destination by a suitable route and does not agree to any specific routing. The Carrier is authorized by Owner to operate and transport Owner's vehicle(s) between its pickup location and the destination set forth on this shipping contract.

3. Owner shall/may authorize someone to accept delivery of the vehicle(s) at the designated destination. Any claim for damage(s) must be noted on the Bill of Lading at time of delivery. Pursuant to federal Highway Administration law any claim for damage(s) must be taken up directly with the trucking company to whom Discount Auto Shippers brokered the shipment. The claim must be submitted to the Carrier within fifteen (15) days, in writing, specifying the damage claimed and must be accompanied by two (2) written estimates for repair and clear photographs of damage claim. If there is damage, liability for same lies solely with the trucking company, not Discount Auto Shippers. Discount Auto Shippers will furnish Owner/Agent with the name, address and phone number of the trucking company used for transport and will assist in providing any other necessary information should a claim arise.

4. Discount Auto Shippers agrees to make all efforts possible to provide the most expedient shipment of described vehicle(s) insofar they won't compromise its standard of safety or quality. Owner understands that ample notice of intent to ship is a primary factor in timely shipments. All delivery dates and time are only estimates. 

5. In the event that there are any problems regarding the transport of the vehicle(s), all outstanding freight charges must be paid without deductions. Owner/Agent agrees to inspect their vehicle(s) upon delivery and note any and all damage claimed on the Bill of Lading while the driver is present and making delivery. Owner warrants that he/she will pay all tariffs due Discount Auto Shippers for delivered vehicle(s) and will not seek to invalidate credit cards charges or stop payment on checks to offset a damage or dispute. Interstate Commerce Commission regulations require that all tariffs be paid in full before a claim can be processed.

6. The Carrier actually transporting the vehicle(s) shall be liable for any and all damage claims arising from the transport. Owner agrees to file all claims which such carrier identified on the Bill of Lading/delivery receipt and to bring any legal actions for damages against such Carrier only. Owner agrees to release and hold harmless Discount Auto Shippers from any such claim. All Carriers hired for vehicle transportation have insurance on file with Discount Auto Shippers and will furnish Owner with the name and phone number of the carrier used in said transportation. Discount Auto Shippers will provide assistance to Owner in providing any necessary information, should a claim arise.

7. Pick up and delivery is from the Owner's door unless residential area restrictions apply, such as low hanging branches, weight restrictions, steep hills, cul-de-sacs, speed bumps or the maneuverability of the truck is hindered. Discount Auto Shippers agrees to provide a Carrier to pickup and delivery your vehicle as promptly as possible in accordance with your instructions, but cannot guarantee pick-up or delivery on a specified date. (Specific day pick-ups are available for an additional fee by a local smaller car carrier).

8. Carrier will attempt to notify Owner/Agent of pick up/delivery of vehicle(s) 12-24 hours prior to either. If the Owner/Agent is not available for pickup, then Carrier's schedule may prohibit their waiting until contact is made. If the Owner/Agent is not available at delivery, after attempted notification of said delivery; the vehicle(s) may be delivered to a terminal at the discretion of Discount Auto Shippers or our Carrier. There may be additional charges incurred for storage, delivery and terminal charges. All additional charges incurred due to notification failure - must be paid by cash or cashiers check to Discount Auto Shippers prior to the release of vehicle(s). Owner/Agent must provide Discount Auto Shippers with complete and correct pick-up and delivery information at the time order is booked. If this information changes prior to pick-up or delivery, a 36-hour notification must be made to circumvent pick-up/delivery problems and additional fees. In the event this information is not relayed to our office or that of the Carrier and the Carrier attempts to pick-up or deliver, the Owner will be responsible for paying any charges related to a dry run and/or re-delivery charges.

9. If your vehicle(s) in non-operational, oversized (longer than 16 feet) has dual rear wheels, is a pick-up truck, van, SUV, or has luggage racks or an extended cab - additional charges will be applied. If the Carrier is not advised of the mentioned conditions/items in the above (first sentence of #10) – additional will be assessed. An additional fee of up to $300 may be assessed for oversize vehicle(s). For an inoperative vehicle(s) a fee up to $200 will be added. If inoperable – they vehicle(s) must roll, steer and break to be transported on a standard car carrier. Owner/Agent is responsible for damage to any other vehicle(s) due to mechanical failure that results in said damage to other vehicle(s).

10. Carrier is not liable for damage caused to Owner's vehicle(s) from excessive of improper loading of personal items. CARRIER IS NOT LICENSED TO TRANSPORT HOUSHOLD GOOD OR PERSONAL ITEMS AND WILL NOT BE RESPONSIBLE FOR ANY LOSS OR CITATIONS AS A RESULT OF EXCESSIVE WEIGHT IN THE VEHICLE(S). CARRIER WILL NOT BE RESPONSIBLE FOR LOSS OR DAMAGE TO PERSONAL BELONGINGS INCLUDING, WITHOUT LIMITATION, ANY PERSONAL PROPERTY WHICH IS NOT FACTORY INSTALLED, THAT ARE NOT PART OF THE VEHICLE(S). Any costs, damage, down time, or citations issued to the Carrier due to excessive weight of vehicle(s) or personal items in the vehicle(s) will be the sole responsibility of Owner. An additional fee may be added if personal items are left in the vehicle(s), based on weight of such items or citations issued to the Carrier due to or caused by excess weight of vehicle(s) or personal items left in vehicle(s), based on weight of such items.

11. THE FOLLOWING ITEMS ARE NOT TO BE IN THE VEHICLE(S) AT TIME OF SHIPMENT: EXPLOSIVES, GUNS, AMMUNITION, FLAMMABLE PRODUCTS, NARRCOTICS, NEGOTIABLE AND LEGAL PAPERS, ALCOHOLIC BEVERAGES, JEWELRY, FURS, MONEY, OTHER ARTICLES OF UNUSUAL VALUE, LIVE PETS, PLANTS OR OTHER CONTRIBAND.

12. Prior to shipment, Discount Auto Shippers shall have rights to refuse to ship Owner's vehicle(s). In such case, Discount Auto Shippers shall return all monies paid to Discount Auto Shippers by Owner/Agent.

13. Any deposit made by Shipper shall be held my Discount Auto Shippers pending the completion of the transport of the vehicle at which time the deposit is applied to the total cost of the vehicle transport. If Discount Auto Shippers is unable to pickup the vehicle for transport within 15 days, the entire amount of the deposit shall be refunded to Customer upon Customer’s request to cancel transport with Discount Auto Shippers. Customer may additionally cancel this agreement at any time prior to 15 days after the vehicle ready date. In such event, a cancellation charge of 100.00 will be deducted from the deposit and the remaining deposit shall be returned to the Customer.

14. Carrier will not knowingly transport uninsured vehicle(s). If vehicle(s) is/are not insured and Owner fails to notify Carrier of such, Carrier is not responsible for any claims made against the owner by third parties (if your car is "junk" and it falls apart on the carrier and damages other vehicle(s) – you are liable for said damage).

15. Any legal action against Discount Auto Shippers must be filed in the Dallas County Courthouse in Dallas, Texas.  Be executing this agreement, Owner waives any and all right to litigate elsewhere.  The prevailing party in any litigation intiated under the agreement shall be entitled to reasonable attorney's fees and court cost involved.

16. If vehicle(s) is vandalized either during shipment or while awaiting shipment, carrier will not be responsible; Owner will have to submit a claim to their own insurance company or absorb the loss if there is no insurance.
